The State of Ohio, Darke County ss.

Be it remembered that on the twenty ninth day of August, in the year of our Lord eighteen hundred and fifty three, before the Probate Court of said county a writing was produced purporting to be the last will and testament of Patrick Harless late of said County dec’d and Riley Gard and Seth Gard the subscribing witnesses to said will appeared in open court and on oath testified to the due execution and attestation of said will, and said testimony reduced to writing and by said witnesses subscribed is annexed to and filed with said will. And it appearing to the court that said will was duly attested and executed, and at the time of the execution thereof the said testator was of full age, of sound mind and memory, and not under any restraint, the court admit said will to probate, and order the same together with the said testimony to be recorded, and the same is in the words and figures following to wit

I, Patrick Harless, of the County of Darke in the State of Ohio, do make and publish this my last will and testament, in manner and form following that is to say:-

First, it is my will that my funeral expenses and all my just debts be fully paid.

Second, it is my will after all is settled up for my wife Catharine Harless to have all that is left, that is now in my possession, and is now owned by me.

And lastly, I hereby constitute and appoint my said wife Catharine Harless, and Samuel Deniston to be the executors for this my last will and testament, and satisfying and confirming this and no other to be my last will and testament.

In testimony whereof I have hereunto set my hand and seal this 19th day of April 1853.

The State of Ohio, Darke County ss.

In Probate Court, August 29th AD 1853, Personally came into open court, Riley Gard & Seth Gard subscribing witnesses to the last will and testament of Patrick Harless late of said county deceased who being duly sworn depose and say that they were present at the execution of the will – that they saw the testator sign, and heard him acknowledge the same as his last will and testament, and that at the time of the execution thereof the said testator was of full age, of sound mind and memory and not under any apparent restraint.

And afterwards on the fifth day of October in the year aforesaid, before the court aforesaid came Catharine Harless widow of the said testator, and the court having explained to her the provisions of said will, and her rights under it, and also her rights by law in the event of her refusing to take under said will, whereupon she made her election in open court to take the provision made for her in the said last will and testament.

And now at this day to wit on the day and year last aforesaid before the court aforesaid came Catharine Harless one of the Executors named in said will and renounced said trust, and Samuel Deniston the remaining executor named therein accepted said trust and gave bond in the sum of ten hundred dollars with Benjamin Wilson and London Arnold his sureties conditioned according to law which is accepted and approved by the Court, whereupon it is ordered that letters testamentary on the said last will and testament issue to the said Samuel Deniston as the Executor thereof.

Last Will and Testament of John Harliss of Hardy County, 1829

I John Harliss of Hardy County and State of Virginia do hereby make my last will and testament in manner and form following, that is to say 1st it is my will and desire that all my debts and funeral expences be first paid. 2nd I give and bequeath unto my two son in laws Samuel May and Michail Handgardner the tract of land they now live on to be equilly divided between the two be it further understood the tract or part of tracts of land that belongs to me joining George Fitzwater on the north east I will and bequeath unto them their heirs executors administrators and assigns forever it is my wish and desire for them to keep same parts they now have in possession. 3rdly I give and bequeath unto my son Isaac Harliss all the rest of my lands lying on Crab run at the mouth of long lick hollow being in two tracts to him his heirs administrators and assigns forever 4thly it is my will and desire that my son Isaac Harliss must pay unto my sons Joseph Harliss John Harliss George Harliss and my two daughters Elizabeth Harliss wife of A. Harliss and Margaret Harless out of the value of his land so as to be equal with himself if they cant agree amongst them selfs the value must be ascertained by three disinterested men be it understood that my six last mentioned children is to be made equal only my son Isaac is to hold the above said land it is my will and desire that all of my personal estate shall be sold and equally divided among all my sons and daughters and lastly I do hereby constitute and appoint Samuel May and Jacob Miller executors of this my last will and testament In witness whereof I have hereunto set my hand and affixed my seal the 11 day of April 1829. Last Will and Testament of James Burwell Harless

State of West Virginia, County of Kanawha and town of Marmet.

I, J. B. Harless, with a sound mind on this the 24th day of February, 1914 in the presents of Albert Hearrold and J. C. Leavens, make my last will and testament to-wit: at my death I hereby make the following disposal of my property:

W. B. Harless, C. D. Harless, Flora Evines and Sybil Harless are to have an equal part of my estate, Improvements to be considered. Sybil Harless is not to come in possession of his part untill he reaches the age of 21 years. In case I should not live I here by name W. B. and C. D. Harless as his Guardian untill he does reach the age of 21 years.

My full meaning of this document is that the Four above named heirs shall shear and shear alike.

P. S. In case that Sybil Harless should die without leaving heirs of his own. His part shall be divided equeal among the other three heirs above mentions.

At a regular session of the County Court of Kanawha County, continued and held forsaid County at the Court House thereof on Saturday the 21st day of March, 1914.

A paper writing purporting to be the last Will and Testament of J. B. Harless,  deceased, late of said County, was this day presented to the Court for probate, and the same being duly proven by the oaths of C. A. Harold and J. C. Leavens, the subscribing witnesses thereto, the said paper writing is admitted to probate and ordered to be recorded as filed as and for the last will and testament of the said decedent.
